Rectification of Clerical Error in Supreme Court Cost Award (1C_431/2023) The Federal Supreme Court rectified a clerical error in the operative part of its own prior decision (1C\_431/2023 of May 19, 2025), where point 3 erroneously stipulated that the successful petitioner (represented by counsel) should pay costs to the respondent. The petitioner sought rectification, and the Court, relying on Article 129(1) of the Federal Supreme Court Act, found that the original disposition contradicted the reasoning (where the petitioner prevailed and was entitled to costs under Article 68(1) and (2) of the Act). The Court corrected the disposition to mandate that the respondent pay the petitioner an indemnity of CHF 3,000 for costs, waiving judicial fees for the rectification procedure as the error was attributable to the Court's oversight, and denying incidental costs for the rectification request because the petitioner's counsel only submitted a simple letter.

Objet
