The case involves a request for the revision of a previous decision by the Swiss Federal Tribunal, where an individual sought to challenge a ruling that had dismissed their appeal against a decision made by the Federal Administrative Court regarding data protection. The individual argued that the Tribunal failed to address specific conclusions and overlooked important facts. However, the Tribunal asserted that it had already considered the individual’s arguments and that the request for revision did not meet the specified grounds for such an action under the law, thus rendering the request inadmissible. Ultimately, the Tribunal emphasized that the process of revision is not meant to re-examine the merits of the case.

Sentenza del 17 ottobre 2011

Composizione

Oggetto

revisione (art. 121 segg. LTF),

domanda di revisione della sentenza del Tribunale federale svizzero 1C_347/2011 del 5 settembre 2011.

Considerando:

che con sentenza 1C_347/2011 del 5 settembre 2011 il Tribunale federale ha respinto, in quanto ammissibile, un ricorso proposto da A.________ contro la decisione emanata il 7 luglio 2011 dalla Corte I del Tribunale amministrativo federale (TAF);

che con scritto del 26 settembre 2011 A.________ chiede al Tribunale federale la revisione della citata sentenza, adducendo una violazione dell'art. 121 lett. c e d LTF, secondo cui la revisione può essere chiesta se il Tribunale non ha giudicato su singole conclusioni, rispettivamente se esso, per svista, non ha tenuto conto di fatti rilevanti che risultano dagli atti;

che la domanda può essere decisa senza procedere a uno scambio di scritti ( art. 127 LTF );

che l'inoltro di un'istanza di revisione non consente di ridiscutere liberamente la sentenza di cui è chiesta la revisione, né di riproporre critiche sulle quali il Tribunale federale si è già pronunciato;

che l'istante, richiamando i motivi di revisione dell'art. 121 lett. c e d LTF, si limita a rimettere in discussione il merito della causa, ribadendo le argomentazioni sollevate con il ricorso in materia di diritto pubblico e insistendo nuovamente sul fatto che le autorità federali non sarebbero intervenute per proteggere i suoi dati;

che, in effetti, contrariamente all'assunto ricorsuale, il Tribunale federale si è pronunciato sulle sue critiche, sottolineando ch'egli non aveva censurato la conclusione del TAF secondo cui egli non aveva diritto, in assenza di una specifica competenza, a un intervento dell'incaricato federale sulla protezione dei dati, né che si era in presenza dell'asserito diniego di giustizia (consid. 1.5);

che non si è in presenza di alcuna svista (art. 121 lett. d LTF), quando, come nella fattispecie, il Tribunale federale ha tenuto conto di determinati fatti, ma non li ha considerati nel modo auspicato dal ricorrente (cfr. sentenza 1F_10/2007 del 2 ottobre 2007 consid. 4.1);

che, infine, il rimedio della revisione non è dato per fare valere che il Tribunale federale, a torto, non sarebbe entrato nel merito di determinate censure, ritenuto che le singole critiche sollevate nel ricorso non costituiscono conclusioni ai sensi dell'art. 121 lett. c LTF (cfr. ELISABETH ESCHER, in: Bundesgerichtsgesetz (BGG), n. 8 all'art. 121);

che, pertanto, la domanda di revisione è inammissibile;

che non vi è quindi alcun motivo per restituire all'istante l'importo di fr. 500.-- delle spese giudiziarie poste a suo carico con la criticata sentenza;

che si può comunque rinunciare a prelevare ulteriori spese processuali ( art. 66 cpv. 1 LTF );

Per questi motivi, il Tribunale federale pronuncia:

1. La domanda di revisione è inammissibile.

2. Non si prelevano spese giudiziarie.

3. Comunicazione all'istante, all'Incaricato federale della protezione dei dati e della trasparenza e al Tribunale amministrativo federale, Corte I.
