Appeal Withdrawal Due to Annulled Reinstatement Order; Appellant Ordered to Pay Costs
Legislator-Zusammenfassung
KI-generiertA legal case arose from an order issued by the Department of Territory of the Republic and Canton of Geneva on July 5, 2021, which required an entity to restore a particular state of affairs. The initial challenge to this order was deemed inadmissible by the Tribunal of First Instance of the Republic and Canton of Geneva on May 24, 2022, prompting an appeal to the Administrative Chamber of the Court of Justice, which was subsequently rejected on November 1, 2022. Further legal proceedings ensued when the party affected by the order appealed to the Swiss Federal Tribunal on December 5, 2022. During this process, the Federal Tribunal granted a temporary suspension of the order's enforcement. However, before a final decision could be made, the appellant withdrew their appeal on May 22, 2023, following a new decision by the Department of Territory, which annulled the initial order. Consequently, the Swiss Federal Tribunal closed the case and assigned the appellant the responsibility to cover the procedural costs.
