Legislator-Zusammenfassung

KI-generiert

In this case, a party submitted an appeal to the Federal Tribunal against a November 25, 2009, decision from a cantonal administrative court, which had dismissed their complaint as inadmissible after the party failed to provide requested documentation. The Federal Tribunal assessed the appeal but found it insufficiently motivated, as the party merely referenced prior complaints without addressing the specific reasons given in the lower court's judgment. Consequently, the tribunal declared the appeal inadmissible without further examination of the merits.

Used to decide on the appeal under the simplified procedure because it was manifestly insufficiently reasoned.

Sentenza dell'8 dicembre 2009

I Corte di diritto pubblico

Composizione

Giudice federale Féraud, Presidente,

Cancelliere Crameri.

Parti

A.________,

ricorrente,

contro

Municipio di Cadro, 6965 Cadro,

Oggetto

richiesta di ripristino di un fondo,

ricorso contro la decisione del 25 novembre 2009 emanata dal Giudice delegato del Tribunale amministrativo del Cantone Ticino.

Considerando:

che con decisione del 25 novembre 2009 il Giudice delegato del Tribunale cantonale amministrativo, dopo aver invitato invano A.________ a produrre la decisione impugnata, ha dichiarato inammissibile un suo reclamo, trattato come ricorso;

che avverso questo giudizio A.________ presenta un'"opposizione" al Tribunale federale, chiedendone in sostanza l'annullamento;

che non sono state chieste osservazioni;

che, come noto al ricorrente, secondo l' art. 42 LTF , il ricorso deve contenere le conclusioni, i motivi e l'indicazione dei mezzi di prova (cpv. 1) e dev'essere motivato in modo sufficiente, spiegando nei motivi perché l'atto impugnato viola il diritto (cpv. 2; DTF 133 II 249 consid. 1.4);

che queste esigenze di motivazione sono del tutto disattese, visto che il ricorrente, limitandosi in maniera inammissibile a rinviare a sue non meglio precisate denunce e a richiamare un suo scritto del 19 novembre 2009, non si confronta del tutto con i motivi addotti nel criticato giudizio;

che il ricorso, manifestamente non motivato in modo sufficiente, può essere deciso sulla base della procedura semplificata dell' art. 108 cpv. 1 lett. b LTF e non può quindi essere esaminato nel merito;

che si può eccezionalmente rinunciare a prelevare spese giudiziarie;

per questi motivi, il Presidente pronuncia:

1. Il ricorso è inammissibile.

2. Non si prelevano spese giudiziarie.

3. Comunicazione al ricorrente, al Municipio di Cadro e al Tribunale amministrativo del Cantone Ticino.

del Tribunale federale svizzero
