A constitutional appeal was filed against a federal initiative approved in a popular vote on November 29, 2009, which aimed to prohibit the construction of minarets. The appellant argued that the initiative was discriminatory and inconsistent with the federal constitution and international law. However, the appeal was deemed manifestly inadmissible because it did not challenge the voting process or violations of electoral rights as outlined by relevant legal provisions, but instead contested the content of the initiative itself. Consequently, the tribunal ruled that there was no legal avenue to contest the content of a federally accepted initiative.

Arrêt du 14 décembre 2009

Ire Cour de droit public

Composition

M. le Juge Féraud, Président.

Greffier: M. Parmelin

Parties

Nicanor Bonich,

recourant,

Objet

"a) la violation des dispositions sur le droit de vote selon les art. 2 à 4, l'art. 5 al. 3 et 6, et les art. 62 et 63 (recours touchant le droit de vote);
