Withdrawal of public-law appeal after settlement; costs allocated to withdrawing appellants under Art. 66(1) LTF.
Legislator-Zusammenfassung
KI-generiertThe Swiss Federal Supreme Court struck the case from the roll, ordering the appellants to pay judicial costs of 800 CHF, with no costs awarded to the respondents. This outcome follows the appellants' withdrawal of their public-law appeal after reaching a settlement with the respondents, meaning the prior cantonal court decision rejecting their challenge remains in force. The underlying dispute concerned a building permit granted by the municipality for the construction of a family villa, the felling of nine trees, and the creation of an access path over an adjacent servitude, against which the appellants had opposed. Withdrawal of an appeal is treated under Article 71 LTF, and under Article 66(1) LTF, the withdrawing party is generally considered the losing party and must bear the procedural costs incurred up to that point; no exception applied here.

Objet
la lettre des recourantes du 17 décembre 2025 par laquelle celles-ci déclarent retirer le recours par suite d'une convention transactionnelle passée avec les intimés;
que la Municipalité de Denges ne saurait prétendre à des dépens (art. 68 al. 3 LTF);
par ces motifs, le Juge présidant ordonne :
