Legislator-Zusammenfassung

KI-generiert

The Swiss Federal Supreme Court struck the case from the docket (rayée du rôle) because the appellants withdrew their appeal following a settlement, with each party bearing its own costs and no party seeking indemnification. The court ordered the judicial costs of CHF 1,000 to be borne by the withdrawing appellants, who are normally treated as the losing party under Art. 66(1) LTF, though costs could have been reduced or waived under Art. 66(2) LTF; no costs were awarded to the respondents. The underlying dispute concerned the alienation of rented apartments, challenging a decision by the Cantonal Court of Vaud (Cour de droit administratif et public) of 29 August 2012, which had been appealed under public-law grounds. The case was at the appellate stage, with the cantonal decision now remaining in force as the final ruling on the merits.

Objet

aliénation d'appartements loués,

recours contre l'arrêt du Tribunal cantonal du canton de Vaud, Cour de droit administratif et public, du 29 août 2012.

Vu:

Le recours en matière de droit public formé le 1er octobre 2012 par A.________ et consorts contre un arrêt de la Cour de droit administratif et public du Tribunal cantonal vaudois du 29 août 2012;

l'ordonnance sur effet suspensif du 31 octobre 2012;

les déterminations de la cour cantonale, du Département cantonal de l'intérieur, Unité logement, et de la société B.________;

la réplique des recourants, du 10 janvier 2013, et l'intervention de la société B.________ du 24 janvier suivant;

la lettre du 14 mars 2013 par laquelle le mandataire des recourants déclare retirer le recours en raison d'un accord entre les parties, chacune d'entre elles gardant ses frais et renonçant à l'allocation de dépens;

la lettre du 18 mars 2013 du mandataire de B.________ confirmant ce qui précède.

Considérant:

que le juge instructeur statue comme juge unique sur la radiation du rôle des procédures achevées par un retrait ( art. 32 al. 2 LTF );

que celui qui retire un recours doit, en principe, être considéré comme une partie succombante, astreinte au paiement des frais de justice encourus jusque-là en application de la règle générale de l' art. 66 al. 1 LTF ;

qu'en cas de retrait ou de désistement, les frais judiciaires peuvent toutefois être réduits ou remis ( art. 66 al. 2 LTF );

qu'il y a lieu en l'occurrence de tenir compte des actes d'instruction effectués (décision d'effet suspensif et échanges d'écritures), la cause étant en l'état d'être jugée;
