The case involves an appellant, represented by legal counsel, challenging a decision by the Federal Criminal Court regarding his extradition to Portugal as approved by the Federal Office of Justice on May 6, 2019. The appeal was lodged on September 2, 2019, following the rejection of an earlier complaint by the appellant against the extradition decision back on August 19, 2019. During the appeals process, the Portuguese authorities withdrew their extradition request, leading to the release of the appellant from extradition custody on September 20, 2019. Both the Federal Office of Justice and the appellant's legal representative agreed with the Swiss Federal Tribunal's proposal to dismiss the case as moot due to the withdrawal of the extradition request.

Art. 32 Abs. 1-2 BGG
Cited as the basis for the single judge (Abteilungspräsident) deciding on the discontinuation of the appeal procedure due to mootness.
Art. 64 Abs. 3 Satz

Art. 71 BGG
Cited in conjunction with Art. 72 BZP regarding the decision on costs due to the procedural turn of events before mootness, and in conjunction with Art. 64 BZP/GG for granting legal aid.
Art. 84 BGG
Cited in the reasoning regarding the lack of entry into the merits because the case was not deemed particularly significant.
Art. 64 Abs. 1-2 BGG
Cited as the basis for granting the appellant's request for legal aid.
Art. 64 Abs. 3 Satz 3 BGG
Cited regarding the power of the Abteilungspräsident to grant legal aid in a summary manner.
Art. 66 BGG
Although no explicit citation of Art. 66 BGG is present in the final orders, point 2.1 states 'Es werden keine Gerichtskosten erhoben', which is a direct application of cost rules. However, adhering strictly to the prompt: point 2.1 is covered by the cost application based on Art. 64 BGG (legal aid) and the general context of costs mentioned in the reasoning referencing BZP/BGG provisions used in point 7, which leads to point 2.1. Since no explicit cost article is listed in the final orders (1, 2, 3) other than contextually via Art. 64 BGG, I will list only the explicitly cited ones in the basis for the orders.

1C_439/2019

Verfügung vom 4. Oktober 2019

I. öffentlich-rechtliche Abteilung

Besetzung

Bundesrichter Chaix, Präsident,

Gerichtsschreiber Forster.

Verfahrensbeteiligte

A.________,

Beschwerdeführer,

vertreten durch Fürsprecher Philipp Kunz,

gegen

Bundesamt für Justiz, Fachbereich Auslieferung, Bundesrain 20, 3003 Bern.

Gegenstand

Internationale Rechtshilfe; Auslieferung an Portugal,

Beschwerde gegen den Entscheid des Bundesstrafgerichts, Beschwerdekammer,

vom 19. August 2019 (RR.2019.123, RP.2019.31).

In Erwägung,

dass A.________ am 2. September 2019 beim Bundesgericht Beschwerde erhob gegen den Entscheid vom 19. August 2019 des Bundesstrafgerichts, Beschwerdekammer, mit welchem dieses eine Beschwerde des Verfolgten gegen den Auslieferungsentscheid vom 6. Mai 2019 des Bundesamtes für Justiz (BJ) abgewiesen hatte;

dass das BJ mit Stellungnahme vom 13. September 2019 die Abweisung der Beschwerde beantragte, soweit darauf einzutreten sei, während das Bundesstrafgericht sich am 10. September 2019 vernehmen liess;

dass der Beschwerdeführer mit Verfügung vom 18. September 2019 eingeladen wurde, eine allfällige Replik bis zum 27. September 2019 einzureichen;

dass das BJ dem Bundesgericht mit Eingabe vom 20. September 2019 (Posteingang: 23. September 2019) mitteilte, dass die ersuchende portugiesische Behörde ihr Auslieferungsersuchen unterdessen zurückgezogen habe, weshalb das BJ am 20. September 2019 die Entlassung des Verfolgten aus der Auslieferungshaft angeordnet habe;

dass das Bundesgericht es den Verfahrensbeteiligten mit Verfügung vom 25. September 2019 frei stellte, bis zum 2. Oktober 2019zur in Aussicht genommenen Abschreibung des Verfahrens (mit Kostenerledigung unter summarischer Begründung, gemäss dem mutmasslichen Prozessausgang vor Eintritt des Abschreibungsgrundes) Stellung zu nehmen;

dass das BJ und der Beschwerdeführer sich mit Eingaben vom 27. bzw. 30. September 2019 mit der vom Bundesgericht in Aussicht genommenen Verfahrenserledigung je einverstanden erklärten;

dass der Instruktionsrichter bzw. Abteilungspräsident als Einzelrichter über die Abschreibung des Beschwerdeverfahrens zufolge Gegenstandslosigkeit entscheidet ( Art. 32 Abs. 1-2 BGG );

dass der Abteilungspräsident auch das Gesuch um unentgeltliche Rechtspflege (einzelrichterlich) gutheissen kann, wenn keine Zweifel bestehen, dass die Voraussetzungen erfüllt sind ( Art. 64 Abs. 3 Satz 3 BGG );

dass das vorliegende Beschwerdeverfahren, angesichts des Rückzuges des Auslieferungsersuchens und der Entlassung des Beschwerdeführers aus der Auslieferungshaft, entsprechend den Anträgen der Verfahrensbeteiligten als gegenstandslos geworden abzuschreiben ist;

dass über die Kostenfolgen mit summarischer Begründung aufgrund der Sachlage vor Eintritt des Erledigungsgrundes zu entscheiden ist ( Art. 72 BZP i.V.m. Art. 71 BGG ), wobei das Bundesgericht nicht auf alle materiellen Streitpunkte einzeln und detailliert einzugehen hat ( BGE 118 Ia 488 E. 4a S. 495; vgl. Matthias Härri, in: Basler Kommentar BGG, 3. Aufl. Basel 2018, Art. 32 N. 21);

dass auf die Beschwerde, aufgrund der Sachlage vor Eintritt des Erledigungsgrundes, mangels Vorliegens eines besonders bedeutenden Falles ( Art. 84 BGG ) wohl nicht einzutreten gewesen wäre, zumal der Beschwerdeführer zur Begründung der gesetzlichen Eintretensvoraussetzung auf seine materiellen Vorbringen verwiesen hat, der vorliegende Fall deutliche Unterschiede gegenüber dem in BGE 122 II 480 beurteilten aufgewiesen hätte, und die Beschwerdesache auch sonst kaum als besonders bedeutend (im Sinne der einschlägigen Bundesgerichtspraxis) einzustufen gewesen wäre (vgl. BGE 145 IV 99 E. 1 S. 104-107; 142 IV 250 E. 1.3 S. 254; 136 IV 20 E. 1.2 S. 22; je mit Hinweisen);
