Prisoner's Appeal Challenging Victim Aid Communication Dismissed
Legislator-Zusammenfassung
KI-generiertIn this case, an individual, while incarcerated, challenged a communication from a victim support center regarding the likelihood of success in pursuing a claim against a hospital's ophthalmology clinic after undergoing a retina transplant. The center had advised that the claim appeared unlikely to succeed due to the individual's prior consent to the operation. However, the court found that the individual's appeal was manifestly inadmissible as it did not come from a cantonal authority of last instance and lacked proper legal motivation. The tribunal also noted that it was not within its purview to provide legal advice on potential further actions related to the matter at hand.

Arrêt du 31 juillet 2014
Ire Cour de droit public
Composition
M. le Juge fédéral Fonjallaz, Président.
Greffière : Mme Arn.
Participants à la procédure
A.________,
recourant,
contre
Opferhilfe beider Basel ,
Objet
Indemnisation fondée sur la loi fédérale sur l'aide aux victimes d'infraction,
recours contre une communication de l'Opferhilfe beider Basel.
Considérant :
que, par lettre du 25 juillet 2014, A.________, incarcéré à la Prison de la Croisée à Orbe, a fait parvenir au Tribunal fédéral une copie d'un courrier du 23 juin 2014 du Centre d'aide au victimes des deux Bâle (Opferhilfe beider Basel; ci-après: Centre LAVI), dont il conteste la teneur;
que, dans ce courrier du 23 juin 2014 rédigé en français, le Centre LAVI indique à A.________ que la poursuite de démarches contre la clinique ophtalmologique de l'hôpital universitaire paraît, après investigations, avoir peu de chance d'aboutir, l'intéressé ayant consenti à l'opération subie (transplantation de la rétine) et signé le formulaire correspondant;
qu'il n'a pas été demandé de réponse, la cause pouvant être jugée immédiatement en application de l' art. 108 LTF ;
que le recours est manifestement irrecevable car l'acte attaqué - à supposer qu'il s'agisse d'une décision - n'émane pas d'une autorité cantonale de dernière instance au sens de l' art. 86 al. 1 let . d LTF (cf. art. 29 al. 3 de la loi fédérale sur l'aide aux victimes [LAVI] et art. 10 de l'ordonnance du canton de Bâle concernant la LAVI);
que, de surcroît, son recours ne répond pas aux exigences légales de motivation posées aux art. 42 al. 2 et 106 al. 2 LTF, les motifs et les conclusions du recours n'étant pas intelligibles;
qu'au demeurant, il n'appartient pas au Tribunal fédéral de prodiguer des renseignements et des conseils sur les éventuelles démarches à entreprendre dans l'affaire concernant le recourant, celui-ci pouvant en revanche s'adresser à un avocat;
que, compte tenu des circonstances, le présent arrêt sera rendu sans frais (art. 66 al. 1, 2
ème phrase, LTF);
par ces motifs, le Président prononce :
1. Le recours est irrecevable.
2. Il n'est pas perçu de frais judiciaires.
3. Le présent arrêt est communiqué au recourant et à l'Opferhilfe beider Basel.
