The case involves a dispute regarding delayed justice related to land use planning in a lakeside area of a municipality. Two individuals filed a complaint against a decision made by the Cantonal Administrative Court, which had dismissed their previous appeal concerning the planning delay. The matter was escalated to the Federal Tribunal, but the individuals failed to submit the required advance payment for court fees by the specified deadline. Consequently, they submitted the payment late, resulting in the court declaring their appeal inadmissible due to non-compliance with procedural requirements.

Sentenza del 18 ottobre 2011

I Corte di diritto pubblico

Composizione

Giudice federale Eusebio, Giudice unico,

Cancelliere Crameri.

Partecipanti al procedimento

1. A.________,

2. B.________,

patrocinate dall'avv. Emanuele Verda,

ricorrenti,

contro

Comune di Agno,

patrocinato dall'avv. Ilario Bernasconi,

Considerando:

che con giudizio del 10 giugno 2011 il Tribunale cantonale amministrativo ha respinto un ricorso per ritardata giustizia in materia pianificatoria sottopostogli da A.________ e da B.________;

che avverso questo giudizio A.________ e B.________ presentano un ricorso al Tribunale federale;

che con decreto presidenziale del 26 agosto 2011 le ricorrenti sono state invitate a fornire, entro il 12 settembre successivo, un anticipo delle spese giudiziarie presunte di fr. 2'000.-- ( art. 62 cpv. 1 LTF );

che, scaduto infruttuoso detto termine, con ulteriore decreto presidenziale del 30 settembre 2011 alle ricorrenti è stato fissato un termine suppletorio, scadente l'11 ottobre 2011, per versare l'anticipo richiesto;

che le ricorrenti hanno versato l'anticipo litigioso soltanto il 12 ottobre successivo e, quindi, tardivamente;

che, pertanto, come espressamente indicato nel secondo decreto presidenziale, il ricorso dev'essere dichiarato inammissibile ( art. 62 cpv. 3 LTF );

che le spese inutili, visto che nel frattempo il Tribunale federale ha proceduto a uno scambio di scritti, sono pagate da chi le causa ( art. 66 cpv. 3 LTF ), ricordato che, di regola, non si accordano ripetibili ai comuni che agiscono nell'ambito delle loro attribuzioni ufficiali ( art. 68 cpv. 3 LTF ; DTF 134 II 117 );

richiamato l' art. 108 cpv. 1 lett. a LTF ;

per questi motivi, il Giudice unico pronuncia:

1. Il ricorso è inammissibile.
