Construction Law Appeal Withdrawn After Settlement
Legislator-Zusammenfassung
KI-generiertIn this case before the Swiss Federal Tribunal, the complainants, represented by a lawyer, filed an appeal related to building and planning law against a court decision from the Canton of Lucerne. The opposing party, also represented by a lawyer, was involved in this legal dispute that was initially decided by the Lucerne Cantonal Court. An out-of-court settlement was reached between the parties in July 2020, leading the complainants to withdraw their appeal on July 22, 2020. Consequently, the Tribunal considered the matter moot and dismissed the case. However, due to procedural costs incurred by the Tribunal during the interim injunction period, the complainants were ordered to pay court costs of 500 Swiss Francs. The decision was formally communicated to all parties involved, including the municipal council of Horw and the Lucerne Cantonal Court.
