The case involves a dispute over a building permit granted for the renovation and expansion of a property located outside of a designated building zone. The permit was originally issued by the local municipality and subsequently confirmed by the Canton’s government and the Cantonal Administrative Court. A party contested this decision by filing an appeal to the Swiss Federal Tribunal, seeking to annul the building permit. However, the appeal was deemed insufficiently motivated as the appellant did not adequately address the legal bases for the lower court's ruling, particularly regarding the lack of standing to appeal since they did not oppose the initial construction request. Consequently, the appeal was declared inadmissible.

Sentenza del 3 maggio 2012

I Corte di diritto pubblico

Composizione

Giudice federale Fonjallaz, Presidente,

Cancelliere Crameri.

Partecipanti al procedimento

A.________,

contro

B.________,

opponente,

Municipio di Torricella-Taverne, 6808 Torricella,

Consiglio di Stato del Cantone Ticino, Residenza governativa, 6500 Bellinzona.

Oggetto

permesso di ristrutturare e ampliare un edificio fuori della zona edificabile,

ricorso contro la sentenza emanata il 16 marzo 2012 dal Tribunale amministrativo del Cantone Ticino.

Considerando:

che il 28 luglio 2011 il Municipio di Torricella-Taverne ha rilasciato a B.________ il permesso per ristrutturare e ampliare un edificio situato fuori della zona edificabile, decisione confermata dal Consiglio di Stato del Cantone Ticino e, con giudizio del 16 marzo 2012, dal Tribunale cantonale amministrativo;

che avverso questa decisione A.________ presenta un "ricorso" al Tribunale federale, chiedendone l'annullamento e la revoca della citata licenza edilizia;

che non sono state chieste osservazioni al ricorso;

che secondo l' art. 42 LTF , il ricorso deve contenere le conclusioni, i motivi e l'indicazione dei mezzi di prova (cpv. 1) e dev'essere motivato in modo sufficiente, spiegando nei motivi perché l'atto impugnato viola il diritto (cpv. 2; DTF 136 I 49 consid. 1.4.1);

che nella fattispecie queste esigenze di motivazione sono disattese, visto che il ricorrente non si confronta del tutto con i motivi formali posti a fondamento del criticato giudizio della Corte cantonale, in particolare con quelli relativi alla sua negata legittimazione a ricorrere, poiché non aveva presentato personalmente un'opposizione alla domanda di costruzione, nonché con quella della carenza di legittimazione dell'opponente, da lui asseritamente rappresentata;

che pertanto il ricorso, manifestamente non motivato in modo sufficiente, può essere deciso sulla base della procedura semplificata dell' art. 108 cpv. 1 lett. b LTF e non può quindi essere esaminato nel merito;

che gli scritti inoltrati da B.________, non richiesti, non possono essere considerati;

che le spese seguono la soccombenza ( art. 66 cpv. 1 LTF );

per questi motivi, il Presidente pronuncia:

1. Il ricorso è inammissibile.

2. Le spese giudiziarie di fr. 500.-- sono poste a carico del ricorrente.

3. Comunicazione alle parti, al Municipio di Torricella-Taverne, al Consiglio di Stato e al Tribunale amministrativo del Cantone Ticino.
