Employee v. Municipality of Lausanne (Time Tracking and Remote Work) The Swiss Federal Supreme Court case concerns an employee who was subject to a decision by the Municipality of Lausanne demanding strict adherence to time-tracking rules, prohibiting manual time entry and all forms of remote work, and initially requiring a medical certificate from the first day of absence (although this last point was later annulled by the Cantonal Court). The employee filed both a public law appeal and a subsidiary constitutional appeal against the Cantonal Court's decision upholding the municipality's directives. The case was ultimately terminated without a substantive ruling because the employee's representative formally notified the Court of the withdrawal of both appeals; consequently, the Court struck the case from the docket and, treating the withdrawal as equivalent to the employee being the unsuccessful party, ordered the appellant to pay judicial costs of CHF 500.
