Legislator-Zusammenfassung

KI-generiert

The case involves a public law appeal submitted by a company against a decision from a regional expropriation court that granted early possession of a part of the company's property. The appeal was filed after the regional administrative court rejected the company's earlier appeal against this expropriation ruling. The company later requested to suspend the proceedings, which was granted multiple times. Ultimately, the company opted to withdraw its appeal, leading to the case being removed from the court's docket, and no judicial costs were incurred.

Composizione

Giudice federale Eusebio, in qualità di Giudice dell'istruzione,

Cancelliere Gadoni.

Partecipanti al procedimento

A.________ SA,

patrocinata dall'avv. Tiziano Bernaschina,

ricorrente,

contro

Oggetto

anticipata immissione in possesso,

ricorso in materia di diritto pubblico contro la sentenza emanata il 12 dicembre 2016 dal Tribunale amministrativo del Cantone Ticino (50.2016.2).

Considerando:

che, per quanto qui interessa, con sentenza del 12 dicembre 2016 il Tribunale cantonale amministrativo ha respinto un ricorso di A.________ SA contro una decisione del 16 agosto 2016 del Tribunale di espropriazione, che accordava l'anticipata immissione in possesso di una parte di un fondo di proprietà della ricorrente;

che avverso questa sentenza A.________ SA ha presentato il 12 gennaio 2017 un ricorso in materia di diritto pubblico al Tribunale federale, chiedendo di annullarla;

che, su istanza della ricorrente, la procedura di ricorso è stata sospesa dal Giudice dell'istruzione con decreti del 23 marzo 2017 e del 24 maggio 2017, dapprima fino al 3 maggio 2017 e in seguito fino al 2 ottobre 2017;

che con scritto del 29 settembre 2017 la ricorrente dichiara di ritirare il ricorso in materia di diritto pubblico;

che il Presidente della Corte, o il Giudice dell'istruzione, decide quale giudice unico circa lo stralcio delle cause ritirate ( art. 32 cpv. 1 e 2 LTF ) e, in tale ambito, statuisce sulle spese giudiziarie;

che in caso di desistenza il Tribunale federale può rinunciare in tutto o in parte a riscuotere le spese giudiziarie ( art. 66 cpv. 2 LTF );

che nella fattispecie si può rinunciare a prelevare spese;
