Legislator-Zusammenfassung

KI-generiert

The Swiss Federal Supreme Court struck the case from the roll (radiation du rôle) as a result of the appellant’s withdrawal of his public-law appeal and subsidiary constitutional appeal, following a settlement between the parties. The appeal had challenged a cantonal administrative court decision upholding an authorization granted by the cantonal housing department for the sale (alienation) of a rented apartment under cantonal legislation on the alienation of leased apartments. The Court ordered that no costs be awarded, and split the reduced judicial costs equally between the appellant and the respondent (250 Swiss francs each), under Articles 32(2), 65(1), and 66(1)–(2) of the Federal Supreme Court Act (LTF); no costs were awarded to the interested third parties, who had not filed submissions. The operative effect is that the cantonal decision remains in force, but the case is closed without a merits ruling.
