Legislator-Zusammenfassung

The Swiss Federal Supreme Court declared the appellant's appeal inadmissible and imposed court costs of 300 francs, affirming the lower cantonal decision that had rejected the appellant's complaint. The case arose from a criminal procedure in which the investigating judge had ordered the appellant to appoint counsel within ten days or face an ex officio defense attorney; the appellant challenged this order via complaint. The Court held that the appeal failed to meet the statutory pleading requirements under Articles 42(2) and 106(2) of the Federal Supreme Court Act, as the appellant's submissions were largely incomprehensible and did not clearly and precisely articulate any violation of constitutional rights, which is required for rulings based on cantonal procedural law. Thus, the appeal was dismissed as irreceivable under Article 108(1) of the same act, and the lower court's decision remained in force.

Arrêt du 23 avril 2008

Ire Cour de droit public

Composition

M. le Juge Féraud, Président.

Greffier: M. Jomini.

Parties

A.________,

recourant,

contre

Juge d'instruction du Bas-Valais, Bâtiment Lavigerie, place Sainte-Marie 6, case postale, 1890 Saint-Maurice.

Objet

95 let. a LTF ).
