Legislator-Zusammenfassung

KI-generiert

A complaint was filed by an individual alleging kidnapping and coercion against another party and a regional authority. The public prosecutor dismissed the case, finding insufficient evidence to support the alleged crimes. The complainant contested this decision, but the appeals court deemed the appeal insufficiently motivated and therefore inadmissible. Subsequently, the complainant submitted a further appeal to a higher court without addressing the specific motivations required for such an appeal, leading to its classification as manifestly unmotivated. Consequently, the higher court decided not to examine the appeal on its merits.

Sentenza del 17 dicembre 2012

I Corte di diritto pubblico

Composizione

Giudice federale Fonjallaz, Presidente,

Cancelliere Crameri.

Partecipanti al procedimento

A.________,

ricorrente,

contro

Considerando:

che il 21 settembre 2012 A.________ ha denunciato B.________ e la Commissione tutoria regionale 6 per titolo di sequestro di persona e rapimento, nonché per coazione;

che con decisione del 5 ottobre 2012 il Procuratore pubblico ha emanato un decreto di non luogo a procedere, non ritenendo dati gli elementi costitutivi degli asseriti reati;

che, adita dal denunciante, con giudizio del 13 novembre 2012 la Corte dei reclami penali del Tribunale d'appello del Cantone Ticino (CRP), ritenuto che il rimedio esperito non adempiva manifestamente i requisiti di motivazione di cui all' art. 385 cpv. 2 CPP , ricordati nel quadro di numerosi ricorsi presentati dal reclamane, l'ha dichiarato irricevibile;

che avverso questa decisione A.________ presenta un "ricorso" al Tribunale federale senza formulare specifiche domande di giudizio;

che non sono state chieste osservazioni al gravame;

che il Tribunale federale esamina d'ufficio se e in che misura un ricorso può essere esaminato nel merito ( DTF 137 I 371 consid. 1);

che, come noto al ricorrente (sentenze 1B_88/2012 del 16 febbraio 2012, 1B_598/2011 del 31 ottobre 2011 e 1B_368/2011 del 18 luglio 2011 nei suoi confronti), secondo l' art. 42 LTF il ricorso deve contenere le conclusioni, i motivi e l'indicazione dei mezzi di prova (cpv. 1) e dev'essere motivato in modo sufficiente, spiegando nei motivi perché l'atto impugnato viola il diritto (cpv. 2; DTF 136 I 49 consid. 1.4.1);

che, come negli altri ricorsi da lui presentati, anche in concreto queste esigenze di motivazione sono manifestamente disattese, visto ch'egli non si confronta affatto con il motivo formale posto a fondamento del criticato giudizio della CRP, segnatamente la carente motivazione del reclamo;

che il ricorso, manifestamente non motivato in modo sufficiente, può quindi essere deciso sulla base della procedura semplificata dell' art. 108 cpv. 1 lett. b LTF e non deve quindi essere esaminato nel merito;

che si può rinunciare a prelevare spese (art. 66 cpv. 1 seconda frase LTF);

per questi motivi, il Presidente pronuncia:

1. Il ricorso è inammissibile.

2. Non si prelevano spese giudiziarie.

3. Comunicazione al ricorrente, al Ministero pubblico e alla Corte dei reclami penali del Tribunale d'appello del Cantone Ticino.
