Denial of Justice Challenge Against Refusal to Act on Prosecutor Denunciation
Legislator-Zusammenfassung
KI-generiertThe case involves a complaint lodged by an individual against a public prosecutor, which was initially dismissed by the Cantonal Council of the Judiciary, stating that the complainant had no party rights except to be informed about the status of the complaint. The complainant then filed an appeal to the Federal Tribunal, alleging denial of justice, arbitrariness, and violations of constitutional rights. The Council clarified that its decisions could be challenged in the Cantonal Court, which was not explicitly stated in the law but supported by legal doctrine. The Federal Tribunal ultimately ruled the appeal was inadmissible because it was not directed against a decision from the last instance at the cantonal level and transferred the matter back to the Cantonal Court for proper handling.

Although mentioned in the reasoning concerning admissibility requirements (Art. 80, 86 et 114 LTF), the final order only explicitly cites Art. 108 LTF for the procedural handling and costs. Since Art. 93 LTF is not explicitly cited in orders 1, 2, or 3, it is excluded based on the established rules.

Arrêt du 16 janvier 2013
Ire Cour de droit public
Composition
M. le Juge fédéral Fonjallaz, Président.

Participants à la procédure

intimé.
Objet
