Inadmissibility of criminal procedure appeal for failure to submit the challenged decision despite cure order; criminal complaint against prosecutor falls outside federal court jurisdiction.
Legislator-Zusammenfassung
KI-generiertThe Swiss Federal Supreme Court (First Public Law Division) declined to enter into the merits of the appeal and dismissed it, ruling in favor of the respondent authority. The appellant had submitted a written complaint labeled as a criminal procedure filing, but the court found it inadmissible because no challenged decision was attached, and the appellant failed to provide one despite a court order to cure the defect by a set deadline; instead, the appellant filed another ambiguous letter. The court held that this failure triggered the statutory dismissal provision, and it further noted that any attempt to file a criminal complaint against a prosecutor lay outside federal court jurisdiction, as such complaints must be directed to the police or the competent public prosecutor's office. The ruling is based on the Swiss Federal Supreme Court Act provisions governing the form and content of appeals, specifically Article 42, paragraphs 3 and 5, read with Article 108, paragraph 1, which authorize dismissal for noncompliant submissions. No court costs were imposed.

Urteil vom 13. Oktober 2021
I. öffentlich-rechtliche Abteilung
Besetzung
Bundesrichter Chaix, präsidierendes Mitglied,
Gerichtsschreiber Pfäffli.
Verfahrensbeteiligte
A.________,
Beschwerdeführer.
Gegenstand
Strafverfahren.
Erwägungen:
A.________ reichte am 1.
2. Auf eine Kostenauflage ist zu verzichten ( Art. 66 Abs. 1 BGG ).
Demnach erkennt das präsidierende Mitglied:
1. Auf die Beschwerde wird wird nicht eingetreten.
2. Es werden keine Kosten erhoben.
3. Dieses Urteil wird dem Beschwerdeführer schriftlich mitgeteilt.
