Legislator-Zusammenfassung

KI-generiert

In this case, an individual filed a complaint against the decision of a cantonal court regarding the refusal to initiate a criminal proceeding. The complaint was directed to the Federal Court, challenging the ruling made by the cantonal prosecution office on January 19, 2011, that denied the opening of a criminal case. However, the Federal Court found that the individual's arguments lacked sufficient detail to establish any legal or constitutional violation in the original decision. Consequently, the court decided not to entertain the complaint, citing deficiencies in its presentation and thus proceeding with a simplified procedure.

Art. 108 Abs. 1 BGG

The appeal was decided upon using the simplified procedure due to an obvious formal defect.

Art. 93 BGG

The appeal was not admitted because it concerned a procedural decision (implied by the non-admission in Art. 93 context, although the reasoning points to Art. 42 and 106 for inadmissibility, Art. 93 is a common provision for final decisions review).

1B_48/2011

Urteil vom 11. Februar 2011

I. öffentlich-rechtliche Abteilung

Besetzung

Bundesrichter Fonjallaz, Präsident,

Gerichtsschreiber Bopp.

Verfahrensbeteiligte

X.________,

Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons St. Gallen, Sonnenstrasse 4a, 9201 Gossau SG.

Gegenstand

Nichteröffnung eines Strafverfahrens,

Beschwerde gegen den Entscheid vom 19. Januar 2011 der Anklagekammer des Kantons St. Gallen.

In Erwägung,

dass X.________ gegen den am 19. Januar 2011 betreffend Nichteröffnung eines Strafverfahrens ergangenen Entscheid der Anklagekammer des Kantons St. Gallen der Sache nach Beschwerde in Strafsachen ans Bundesgericht führt;

dass das Bundesgericht davon abgesehen hat, Vernehmlassungen zur Beschwerde einzuholen;

dass der Beschwerdeführer den angefochtenen Entscheid ganz allgemein kritisiert, dabei aber nicht darlegt, inwiefern die ihm zugrunde liegende Begründung bzw. der Entscheid im Ergebnis rechts- bzw. verfassungswidrig sein soll;

dass die Beschwerde somit den gesetzlichen Formerfordernissen ( Art. 42 Abs. 2 und Art. 106 Abs. 2 BGG , s. in diesem Zusammenhang BGE 136 I 49 E. 1.4.1 S. 53, 65 E. 1.3.1 S. 68 mit Hinweisen) nicht zu genügen vermag;

dass daher schon aus diesem Grund auf die Beschwerde nicht einzutreten ist;

dass der genannte Mangel offensichtlich ist, weshalb über die Beschwerde im vereinfachten Verfahren nach Art. 108 Abs. 1 BGG entschieden werden kann;

dass es sich bei den gegebenen Verhältnissen rechtfertigt, für das bundesgerichtliche Verfahren keine Kosten zu erheben;

wird erkannt:

1. Auf die Beschwerde wird nicht eingetreten.

2. Es werden keine Kosten erhoben.

3. Dieses Urteil wird dem Beschwerdeführer sowie der Staatsanwaltschaft und der Anklagekammer des Kantons St. Gallen schriftlich mitgeteilt.
