Appeal Regarding Prosecutor Recusal Inadmissible Due to Insufficient Motivation
Legislator-Zusammenfassung
KI-generiertIn this case, a party contested a decision made by the Cantonal Court of Vaud, which had rejected a request for the recusal of a prosecutor in a criminal proceeding. The party submitted a formal notification of intent to appeal to the Federal Tribunal, indicating that a detailed appeal would follow within a specified timeframe. However, the Federal Tribunal noted that under applicable Swiss law, there is no requirement for an advance notification of appeal and that the appeal must be motivated within the statutory deadline. The Tribunal found that the appeal did not meet the legal requirements for motivation, as it failed to clearly articulate how the contested decision violated the law, leading to the conclusion that the appeal was inadmissible.

Although not explicitly cited in the dispositive, the decision to waive court fees implies the application of the general rules on costs, which often includes Art. 64 LTF regarding legal aid/costs when a waiver is pronounced, but since the text only mentions waiving fees (Art. 66), and the reasoning states 'il peut être renoncé à la perception de frais judiciaires', the relevant cost article is Art. 66.
Used in the dispositive to rule that no judicial costs shall be levied.

Objet
Procédure pénale; récusation d'un procureur,
recours contre l'arrêt du Tribunal cantonal du canton de Vaud, Chambre des recours pénale, du 21 août 2018 (600 - PE14.013845 PE14020604).
Considérant :
que par arrêt du 21 août 2018, la Chambre des recours pénale du Tribunal cantonal vaudois a rejeté une demande de récusation formée par A.________ contre le Procureur de l'arrondissement de Lausanne Eric Reynaud;
que par acte daté du 22 septembre 2018 A.________ déclare former une "annonce de déclaration de recours", précisant qu'il fournira un mémoire de recours dans le délai à fixer par le Tribunal fédéral;
que conformément à l' art. 100 al. 1 LTF , le délai pour recourir au Tribunal fédéral est de 30 jours dès la notification complète de la décision attaquée;
que contrairement à l' art. 399 CPP , la LTF ne prévoit pas d'annonce et de déclaration de recours;
que le délai de recours fixé par la loi ne peut être prolongé ( art. 47 al. 1 LTF ) et que les mémoires adressés au Tribunal fédéral doivent donc être motivés dans ce même délai;
qu'en l'occurrence, le recours ne satisfait manifestement pas aux exigences de motivation posées à l' art. 42 al. 2 LTF ;
qu'il ne suffit pas, selon cette disposition, d'énumérer de manière générale des motifs de recours (violation du droit de procédure, constatation erronée et incomplète des faits, excès et abus du pouvoir d'appréciation, retard injustifié notamment);
que le recourant doit également indiquer, ne serait-ce que brièvement, en quoi l'acte attaqué viole le droit;
qu'aucune indication de ce genre ne figure dans le recours, de sorte que celui-ci doit être déclaré irrecevable selon la procédure simplifiée de l' art. 108 al. 1 let. a LTF ;
