The Swiss Federal Supreme Court declared the appellant’s criminal-law appeal inadmissible and imposed court costs of CHF 300, dismissing the request for legal aid; the challenged decisions of the Ticino Court of Appeal (CARP) of 3 September 2013, which had rejected the appellant’s recusal requests against the presiding judge and another judge of the CARP, thus remain in force. The appellant had sought to recuse those judges after they had already ruled against him in a prior appeal decision of 16 July 2013, arguing bias based on their past conduct. The Court held the appeal was manifestly insufficiently reasoned under Art. 42 para. 2 LTF, noting that the appellant failed to address each independent and sufficient ground of the lower court’s reasoning (including the tardiness of the recusal motion, the novelty of the alleged facts, and the improper attempt to file the motion via the Federal Supreme Court), and merely reasserted arguments already rejected in earlier parallel proceedings; recusal issues were also outside the scope of the current dispute. The decision was issued under Art. 108 para. 1 lit. b LTF, with costs imposed under Art. 66 para. 1 LTF and legal aid denied under Art. 64 para. 1 LTF for lack of success prospects.

Sentenza del 30 ottobre 2013

Oggetto

ricusa,

Diritto:

1.

42 cpv. 2 LTF ; DTF 138 I 171 consid. 1.4, 225 consid. 3.2). L'atto di ricorso in esame disattende completamente queste esigenze di motivazione.
