Legislator-Zusammenfassung

In this case, an individual filed an appeal against a decision made on July 20, 2015, by the Criminal Appeals Court of the Canton of Ticino. The individual contested the rejection of a complaint regarding delayed justice. The Federal Tribunal examined the timeliness of the appeal filed against the Cantonal decision, highlighting the applicable legal provisions that determined the deadline for submitting the appeal. The Tribunal found that the appeal was submitted after the deadline had expired, leading to a conclusion that the appeal was clearly inadmissible and thus could not be examined on its merits.

Sentenza del 29 settembre 2015

I Corte di diritto pubblico

Composizione

Giudice federale Fonjallaz, Presidente,

Cancelliere Crameri.

Partecipanti al procedimento

A.________,

ricorrente,

contro

Ministero pubblico del Cantone Ticino, palazzo di giustizia, via Pretorio 16, 6901 Lugano.

Oggetto

procedimento penale; denegata e ritardata giustizia,

ricorso contro la sentenza emanata il 20 luglio 2015

dalla Corte dei reclami penali del Tribunale d'appello

del Cantone Ticino.

Considerando:

che con giudizio del 20 luglio 2015 la Corte dei reclami penali del Tribunale d'appello del Cantone Ticino ha respinto, in quanto ricevibile, un reclamo di A.________;

che avverso questa decisione A.________ presenta un ricorso in materia penale al Tribunale federale, chiedendo di annullarla;

che il Tribunale federale esamina d'ufficio se e in che misura un ricorso può essere esaminato nel merito ( DTF 140 I 252 consid. 1);

che secondo l' art. 100 cpv. 1 LTF il ricorso contro una decisione dev'essere depositato presso il Tribunale federale entro 30 giorni dalla notificazione del testo integrale della stessa;

che il ricorrente, precisato che la decisione impugnata gli è stata intimata il 25 luglio 2015, riguardo a detto termine accenna alle ferie giudiziarie;

che secondo l' art. 46 cpv. 1 lett. b LTF i termini ricorsuali sono sospesi dal 15 luglio al 15 agosto incluso;

che secondo l' art. 44 cpv. 1 LTF , i termini la cui decorrenza dipende da una notificazione decorrono, contrariamente alla disciplina prevista dal previgente art. 32 cpv. 1 OG , a partire dal giorno successivo, ossia, qualora, come in concreto, la decisione sia stata notificata durante le ferie giudiziarie, il 16 agosto 2015 ( DTF 132 II 153 consid. 4.2 pag. 1588; sentenze 1B_30/2008 del 12 febbraio 2008 consid. 2 e rinvii, 9C_296/2007 del 20 giugno 2007; JEAN-MAURICE FRÉSARD, in Commentaire de la LTF, 2aed. 2014, n. 6 lett. c ad art. 46 e n. 7 e 8 ad art. 44); la circostanza che si tratti di una domenica è irrilevante, essendo decisivo soltanto qualora si tratti dell'ultimo giorno di scadenza del termine ricorsuale e non quello di avvio ( art. 45 cpv. 1 LTF );

che pertanto, nel caso in esame, il termine ricorsuale scadeva lunedì 14 settembre 2015, motivo per cui il ricorso, impostato soltanto il 15 settembre seguente, come risulta dal timbro postale e dalla datazione del gravame, è tardivo (cfr. art. 48 cpv. 1 LTF );

che il ricorso, manifestamente inammissibile poiché tardivo, non può quindi essere esaminato nel merito e può essere deciso sulla base della procedura semplificata dell' art. 108 cpv. 1 lett. a LTF ;

che le spese seguono la soccombenza ( art. 66 cpv. 1 LTF );

per questi motivi, il Presidente pronuncia:

1. Il ricorso è inammissibile.
