In this case, an individual was involved in a criminal proceeding for defamation and requested the appointment of a public defender. The request was denied by the investigating judge on the grounds that it was a minor case. Subsequently, the appellate court upheld this decision, determining that the individual was capable of defending their interests against a proposed suspended fine and additional penalty. The individual then filed an appeal to the Federal Tribunal, which found that the appeal was inadequately motivated and therefore deemed it inadmissible. The tribunal also decided not to impose court costs.

Sentenza del 28 ottobre 2009

I Corte di diritto pubblico

Composizione

Giudice federale Féraud, Presidente,

Cancelliere Crameri.

Parti

A.________,

ricorrente,

contro

Ministero pubblico del Cantone Ticino,

opponente.

Oggetto

patrocinio d'ufficio,

ricorso contro la sentenza emanata il 1° ottobre 2009 dalla Camera dei ricorsi penali del Tribunale d'appello

del Cantone Ticino.

Considerando:

che nell'ambito di un procedimento penale promosso nei suoi confronti per titolo di ingiuria, A.________ ha chiesto di nominargli un difensore d'ufficio;

che con decisione del 31 agosto 2009 il Giudice dell'istruzione e dell'arresto, ritenuto si tratti di un caso bagatella, ha respinto la richiesta;

che con giudizio del 1° ottobre 2009 la Camera dei ricorsi penali del Tribunale d'appello ha respinto un ricorso dell'istante, posto in stato d'accusa dinanzi alla Pretura penale con una proposta di condanna a una pena pecuniaria, sospesa condizionalmente, di cinque aliquote giornaliere di fr. 40.-- ciascuna e a una multa di fr. 200.--, ritenuto che il Procuratore pubblico rinuncerà a partecipare al dibattimento e che dagli atti risulta che l'insorgente è capace di difendere i suoi interessi;

che avverso questa sentenza A.________ presenta un "ricorso" al Tribunale federale;

che secondo l' art. 42 LTF , il ricorso deve contenere le conclusioni, i motivi e le indicazioni dei mezzi di prova (cpv. 1) e dev'essere motivato in modo sufficiente, spiegando nei motivi perché l'atto impugnato viola il diritto (cpv. 2);

che queste esigenze di motivazione sono del tutto disattese, visto che il ricorrente non si confronta con i motivi addotti nel criticato giudizio, limitandosi in maniera inammissibile a rinviare agli atti cantonali;

che il gravame, non motivato, può essere deciso sulla base della procedura semplificata dell' art. 108 cpv. 1 lett. b LTF e non può quindi essere esaminato nel merito;
