Legislator-Zusammenfassung

KI-generiert

The Swiss Federal Supreme Court struck the case from the roll after the appellants withdrew their criminal-law appeal, thereby upholding the prior instance’s decision (Cantonal Appeal Chamber of Vaud, 23 December 2012) that had confirmed the prosecutor’s refusal to order a sequestration of the respondent’s profit share from a real-estate sale in a fraud and forgery investigation. The appellants, who had filed the appeal against the refusal to seize assets, were ordered to bear the court costs of CHF 500 and to pay CHF 1,500 in compensation to the respondent, based on the rule that a withdrawing party is treated as the losing party (Art. 73 PCF via Art. 71 LTF; Art. 32 para. 2 LTF; Art. 428 para. 1 CPP; Art. 66 and 68 LTF). The procedural outcome is a dismissal of the appeal due to withdrawal, with the lower court’s refusal of sequestration remaining in force.
