The case involves an individual who was summoned by the public prosecutor's office for an interview after contesting a penalty order issued for multiple speeding violations. The individual left the interview without authorization, resulting in a fine of CHF 300. Subsequently, the individual requested the annulment of the fine and filed a complaint against the prosecuting attorney for alleged abuse of office, claiming the summons lacked a legal basis, violated his rights, and involved unlawfully used radar photos. The cantonal prosecutor's office decided not to pursue an investigation against the attorney, prompting the individual to appeal to the cantonal court, which dismissed his complaints regarding both the disciplinary fine and the decision not to proceed with a legal investigation. The individual further challenged these dismissals by filing a complaint to the Swiss Federal Tribunal.

Art. 42 Abs. 2 BGG
The court refers to the requirement to demonstrate compliance with the admissibility prerequisites for the appeal.
Art. 108 Abs. 1 lit. a LTF
The court explicitly states it will not enter upon the appeal in the simplified procedure due to the evident lack of substantiation (although the explicit citation for simplified procedure is implicit in the reasoning concluding application of 'im vereinfachten Verfahren', Art. 108 a LTF is the standard basis when mentioning 'vereinfachten Verfahren' without further explicit citation in the dispositive itself, but here the dispositive only states non-entry of the appeal).
Art. 66 al. 1 LTF
Cited indirectly by explicitly ordering that no costs shall be raised (though the explicit citation for cost exemption is Art. 64 LTF, the actual cost order is covered by the general framework, but since the dispositive explicitly states 'keine Kosten', the general rule for costs, Art. 66 al. 1 LTF, is the default reference, however, the text explicitly mentions 'Auf die Erhebung von Kosten kann ausnahmsweise verzichtet werden' followed by order 2 'Es werden keine Kosten erhoben.' Since the reasoning mentions waiving costs and order 2 confirms no costs, Art. 66 al. 1 LTF deals with imposing costs, while *Art. 64 LTF* deals with legal aid/costs exemption. Given the context of waiver, Art. 64 LTF is more relevant for the waiver mentioned in the reasoning, but since order 2 is 'Keine Kosten', and no article on cost exemption is cited in the dispositive, we rely only on provisions explicitly cited in the dispositive. Since no provision is cited in the dispositive except for the implied procedural basis, we check the actual orders again.

Urteil vom 13. Mai 2020

I. öffentlich-rechtliche Abteilung

Besetzung

Bundesrichter Chaix, Präsident,

Gerichtsschreiber Störi.

Verfahrensbeteiligte

A.________,

Beschwerdeführer,

gegen

Ivo Kümin, Staatsanwaltschaft Höfe Einsiedeln,

Beschwerdegegner,

Staatsanwaltschaft Höfe Einsiedeln,

Staatsanwaltschaft des Kantons Schwyz

Sicherheitsstützpunkt Biberbrugg.

Gegenstand

Strafverfahren,

Beschwerde gegen die Verfügungen des Kantonsgerichts

Schwyz, Kantonsgerichtsvizepräsident,

vom 20. April 2020 (BEK 2019 200, BEK 2020 50).

Sachverhalt:

A. Die Staatsanwaltschaft Höfe Einsiedeln lud A.________ auf den 26.

Dagegen erhob A.________ Beschwerde ans Kantonsgericht.

1. Auf die Beschwerde wird nicht eingetreten.

2. Es werden keine Kosten erhoben.

3. Dieses Urteil wird den Parteien, der Staatsanwaltschaft Höfe Einsiedeln, der Staatsanwaltschaft des Kantons Schwyz Sicherheitsstützpunkt Biberbrugg und dem Kantonsgericht Schwyz, Kantonsgerichtsvizepräsident, schriftlich mitgeteilt.
