Legislator-Zusammenfassung

KI-generiert

The Swiss Federal Supreme Court declared a submission by the defendant in a pending criminal investigation irreceivable and ordered no costs, leaving the underlying criminal proceedings (for defamation, insult, and threats) intact. The defendant had filed a "pourvoi en nullité" seeking annulment of the entire investigation and related costs, alleging procedural irregularities and violations of his rights as an accused. The Court held that it is essentially a court of last resort for appeals against final cantonal or federal criminal decisions and cannot be directly seized to declare the nullity of a prosecutor's acts or to annul an ongoing investigation outside the statutory appeal framework; no decision amenable to appeal under Articles 78 ff. or 113 ff. LTF was identified, nor a denial of justice or undue delay under Article 94 LTF, and the "pourvoi en nullité" is not a recognized remedy.

Arrêt du 4 avril 2023

Ire Cour de droit public

Composition

M. le Juge fédéral Müller, Juge présidant.

Greffier : M. Parmelin.

Participants à la procédure

A.________,

contre
