Sentence Reduction Due to Statutory Maximum in Collegiate Court Proceedings
Legislator-Zusammenfassung
KI-generiertA defendant was convicted of offenses including human trafficking and promoting prostitution, resulting in a calculated aggregate sentence of 54 months of imprisonment and 190 daily fines. However, the appellate court ruled that because the tribunal of first instance was a three-judge collegiate court, the imposed sentence, cumulating all penalties, could not exceed a maximum of five years of imprisonment (or 1,800 penalty units), a limitation stemming from Art. 56 para. 2 lit. b of the Cantonal Law on the Judiciary (EG ZSJ), which binds both the prosecution and the court. Since the calculated sentence slightly exceeded this five-year limit, and given the minor nature of the excess, the court directly reduced the sentence to 4.5 years of imprisonment and 180 daily fines to avoid nullifying the conviction and remanding the case.
