Supplementary Benefits Calculation Dispute and Settlement
Legislator-Zusammenfassung
KI-generiertThe case involved a dispute over the calculation of supplementary benefits, where the claimant contested the daily rate for their institutional care. During the appeal, the respondent social insurance authority partially conceded, proposing to revoke the contested decision and recalculate the supplementary benefits based on an annual care fee of CHF 36,376 (CHF 99.66 per day), justifying this with the actual costs charged by the institution and accounting for a double-billing error. The claimant, who initially sought a higher daily rate of CHF 110.40, subsequently agreed to the respondent's proposal, resulting in a joint motion by the parties which the court found to be consistent with the factual and legal situation. The court therefore upheld the appeal, annulled the contested decision, and remanded the case to the social insurance authority to recalculate the supplementary benefits according to the mutually agreed terms, without charging court costs or awarding costs to the claimant, as the effort involved was deemed within the normal scope of professional representation.

Urteil des Einzelrichters vom 27. April 2020
Verwaltungsrichter Schütz Gerichtsschreiberin Schädeli
A.________ vertreten durch Regionaler Sozialdienst B.________, C.________, Beschwerdeführer
gegen
Ausgleichskasse des Kantons Bern Abteilung Ergänzungsleistungen, Chutzenstrasse 10, 3007 Bern Beschwerdegegnerin
betreffend Einspracheentscheid vom 29. November 2019 Urteil des Verwaltungsgerichts des Kantons Bern vom 27. April 2020, EL/2020/31, Seite 2
Fr. 99.66 pro Tag neu zu berechnen seien;
dass die Beschwerdegegnerin darauf zu behaften ist;
dass sie diesen Antrag mit den von der Stiftung D.________ dem Beschwerdeführer tatsächlich in Rechnung gestellten Kosten einerseits und einer darin enthaltenen Doppelverrechnung anderseits nachvollziehbar begründete;
dass der Beschwerdeführer, welcher beschwerdeweise die Erhöhung der täglichen Heimtaxe auf Fr. 110.40 beantragt hatte, nach Einsichtnahme in die Beschwerdeantwort sich dem Antrag der Beschwerdegegnerin anschloss und mit Prozesserklärung vom 23. April 2020 sein Rechtsbegehren auf diesen Antrag beschränkte;
dass somit ein gemeinsamer Antrag der Parteien vorliegt, welcher – entsprechend der vom Gericht summarisch vorzunehmenden Prüfung
– der Sachund Rechtslage entspricht;
dass das Verfahren kostenlos ist;
dass der Beschwerdeführer trotz teilweisem formellen Obsiegens nicht Anspruch auf eine Parteikostenentschädigung hat, überstieg doch der durch die Beschwerdeführung seiner Berufsbeiständin entstandene Aufwand das übliche Mass dessen nicht, was im Rahmen eines selbst oder als Berufsbeistand geführten Verfahrens erwartet werden darf;
dass für diesen Entscheid der Instruktionsrichter als Einzelrichter zuständig ist.
Urteil des Verwaltungsgerichts des Kantons Bern vom 27. April 2020, EL/2020/31, Seite 3
