Claimant v. Defendant: Monetary Claim Acknowledgment and Judgment
Legislator-Zusammenfassung
KI-generiertThe claimant sought payment for a monetary claim, including capital, interest, and costs of ongoing debt collection proceedings. The defendant, represented by counsel, subsequently acknowledged the claim in a submission to the court dated November 15, 2017, effectively conceding the full demand made in the October 3, 2017, action. The court, therefore, granted the claim, condemning the defendant to pay CHF 5,813.45 plus cumulative interest and CHF 500 in collection costs, and lifting the objection (Rechtsvorschlag) in the debt collection proceedings to grant definitive legal execution (definitive Rechtsöffnung). Since the defendant did not remain inactive and reacted to the claim by filing the acknowledgement, the court refrained from levying court costs, which would have been imposed if the defense was deemed willfully dilatory.

Since the analysis must strictly follow the dispositive (orders 1-4), and this article is not cited in them, it should be excluded based on the strict rule.
