Court Costs and Guardian Compensation in Non-Contentious Proceedings
Legislator-Zusammenfassung
KI-generiertIn non-contentious proceedings, a party seeking recourse for court costs or their own legal expenses when the court erred cannot recover these from the canton, as the law provides no basis for such compensation. While costs not attributable to any party might be borne by the canton for reasons of equity, this does not extend to party compensation. Similarly, a final report from a guardian serves informational purposes and is not subject to appeal regarding the guardian's conduct; any misconduct must be addressed through a separate action for liability. Municipalities are free to set compensation for child and adult protection officers, and the responsible authority does not need to verify the municipality's internal payment obligations when determining the officer's fees. Guardians are entitled to reasonable compensation and expenses from the protected person's assets, but if these assets fall below a minimum threshold, the municipality covers these costs.

316 Obergericht, Abteilung Zivilgericht 2014
Abs. 2 ZPO).
