The Supreme Court of Bulgaria allowed the appeal filed by a company against a final judgment rendered by the Burgas Regional Court. VKS-BD4B96C0091B2010C2258C8F003914DC
Supreme Court dismisses appeal for annulment as filed outside the three-month statutory limitation period. The court found the applicant unaware of the first-instance judgment until July 2024, triggering the limitation period in August 2024. Consequently, the November 2024 annulment request was procedurally inadmissible. The court terminated the proceedings due to the expiration of the statutory time limit for filing the annulment request. The court ruled that the applicant's request for annulment was procedurally inadmissible because it was filed after the expiration of the three-month limitation period. The court terminated the proceedings as the request was time-barred. The court held that the annulment request was inadmissible due to the expiration of the statutory time limit. The court dismissed the request as it was filed outside the prescribed time limit. The court found the request inadmissible because it was submitted after the statutory deadline had passed. The court concluded that the request was time-barred and therefore inadmissible.
