Р А З П О Р Е Ж Д А Н Е

гр. София, 05.01.2017 г.

бойка стоилова – председател на четвърто гражданско отделение при гражданска колегия на Върховния касационен съд, при проверка на допустимостта на преписка вх. № 1 от 03.01.2017 г. , констатира следното:

Преписката е образувана по касационна жалба вх. № 7243/16.11.2016г. срещу решение №149 от 07.10.2016г., постановено по в.гр.д. №333/2016г. по описа на Апелативен съд-Варна.

Изложението по чл.284, ал.3, т.1 ГПК към касационната жалба вх. № 7243/16.11.2016г., подадена от С. С. Щ. и М. Й. Щ., чрез адв.Д. Д. не отговаря на изискванията за редовност на разпоредбата на чл. 284 ГПК, а именно: не е посочено името на лицето, подписало изложението на основанията за допускане на касационно обжалване , поради което преписката следва да бъде върната на въззивния съд за привеждане в съответствие с тях.

По изложените съображения, председателят на четвърто отделение на Гражданска колегия на Върховния касационен съд,

Р А З П О Р Е Д И :

ВРЪЩА преписка вх. № 1 от 03.01.2017 г. на Апелативен съд-Варна, за извършване на проверка на редовността и отстраняване на допуснатите нередовности, с оглед дадените указания.
