Si sa validité n'est pas subordonnée à l'acceptation de la

partie intimée, le désistement d'appel qui intervient avant que

cette partie ait conclu sur l'objet de la demande à laquelle il

est renoncé ne peut, en l'absence de cette acceptation, la priver
