The Court of Cassation held that a mandatory restoration order under Article 16.6.4 of the Flemish Waste Decree is not automatically applicable if the proven crime's consequences have vanished due to administrative decisions or factual circumstances. The defendant argued that since the waste was no longer present, the restoration measure was unnecessary, a point supported by the prosecution's evidence. The court ruled that while the order is mandatory, the judge must still verify its necessity to ensure the crime's consequences are eliminated, leading to the dismissal of the appeal regarding the automatic imposition of the measure.

Article 16.6.4, first paragraph, of the Flemish Waste Decree of 5 April 1995; The mandatory nature of a restoration order for leaving waste does not compel the criminal court to order it if the consequences of the crime have disappeared, requiring the court to examine the necessity of the measure.
