Synthèse Legislator

Généré par l'IA

The Court of Cassation dismissed the applicant's challenge regarding the retroactive loss of Belgian nationality due to a sham marriage. The applicant argued that the principle of 'fraus omnia corrumpit' should invalidate the nationality loss, but the court held that Article 23 of the Law of 28 June 1984 strictly defines the modalities for such deprivation. Consequently, the court ruled that the principle of good faith cannot override the specific statutory provisions governing nationality loss.

(1) Zie
