The Court of Justice of the European Union ruled that the principle of effectiveness mandates the state to bear the consequences of expired refund claims made by intermediaries. A private individual acting as an intermediary paid an illegal tax on behalf of another and was subsequently claimed for the overpayment. The court determined that the state must absorb the loss even if the intermediary's personal statute of limitations had expired. This decision ensures that national procedural rules do not render the right to recover illegal payments practically impossible.
