Fiche 1 Wanneer het Grondwettelijk Hof vaststelt dat een wet ongrondwettelijk is, dan heeft die beslissing in de regel een declaratief karakter en werkt zij dus retroactief; hieruit volgt dat het Hof een in laatste aanleg gewezen rechterlijke beslissing kan vernietigen wanneer de wetsbepaling die ten grondslag ligt aan die beslissing, vernietigd werd door het Grondwettelijk Hof, ook al werd het vernietigingsarrest van het Grondwettelijk Hof gewezen en bekendgemaakt na de uitspraak van die rechterlijke beslissing (1).
