Synthèse Legislator

Généré par l'IA

The Court of Cassation allowed the appeal against a decision imposing vacant land tax, ruling that force majeure can be established by reasons entirely outside the landholder's will. The landholder argued that the vacancy resulted from circumstances making it unreasonable to expect them to terminate the vacancy, distinguishing this from general legal interpretations. The court accepted this broader definition of force majeure to prevent unjust taxation when the landholder could not reasonably control the situation.
