Synthèse Legislator

Généré par l'IA

The Court of Cassation dismissed the taxpayer's cassation appeal concerning the tax administration's requalification of a lease arrangement. The administration argued that splitting a single lease into multiple contracts artificially avoided tax, citing Article 344 of the Income Tax Code. The court upheld the administration's power to reclassify such transactions when they lack genuine economic substance, rejecting the taxpayer's procedural and substantive defenses.

Regeste Legislator

Généré par l'IA

Articles 378 and 379 of the Income Tax Code; Article 344, Section 1 of the Income Tax Code: The tax administration may reclassify split transactions as a single operation if they lack genuine economic substance, provided the reclassification yields similar non-fiscal legal consequences.

Fiche 3
