Failure to cure defectively framed complaint for failure to act leads to procedural termination
Legislator-Zusammenfassung
KI-generiertThe Administrative Court of Vienna (VwGH) ordered the termination of the proceedings, resulting in a procedural default against the complainants, because they failed to cure defects identified in their initial filing within the prescribed deadline. The dispute involved a filing characterized by the complainants as a "complaint for failure to act" (Säumnisbeschwerde) under Art. 131 Abs. 1 of the Federal Constitutional Law, which the Court found ambiguous as to whether it constituted a complaint for inaction or a request for a deadline, prompting a remedial order issued on June 10, 2020. Citing §§ 38 Abs. 4, 34 Abs. 2, and 33 Abs. 1 of the Administrative Court Act (VwGG), the Court dismissed the case due to the complainants' failure to comply with the order to rectify these procedural deficiencies, leaving the underlying administrative matter unresolved by this specific judgment.
