Termination of VwGH proceedings following belated administrative decision and award of statutory expense reimbursement under the VwGH Expense Replacement Ordinance
Legislator-Zusammenfassung
KI-generiertThe Administrative Court of Justice (VwGH) dismissed the applicant's excess claim for legal costs but ordered the federal government to pay the applicant EUR 553.20 in expenses within two weeks under threat of execution, thereby establishing that the applicant recovered the statutory lump sum despite the prior instance's delayed compliance. The dispute concerned a procedural delay where the Federal Administrative Court failed to issue a timely decision, prompting an application for a deadline to be set, which was resolved when the Federal Administrative Court subsequently issued its judgment and submitted the record to the VwGH. The court dismissed the proceedings on the merits because the belatedly performed administrative act cured the violation, and the costs award was strictly limited by the second sentence of § 56 para 1 VwGG in conjunction with the VwGH Expense Replacement Ordinance 2014, specifically § 1 Z 1 lit. a second case, which caps reimbursement at the prescribed lump sum.
Legislator-Regeste
KI-generiert§ 38 Abs. 4 VwGG; § 56 Abs. 1 VwGG: If a lower court fails to issue a decision within the prescribed time limit, the proceedings must be set aside, and the higher court must order the state to reimburse the applicant's costs up to the statutory cap.
