Mootness of administrative court time-limit application following lower court decision on pending appeal
Legislator-Zusammenfassung
KI-generiertThe administrative court declared the application for a time limit moot and terminated the proceedings, ordering the respondent federal authority to pay the applicant €793.20 in costs while dismissing the excess request. This decision resolved a procedural dispute under the Administrative Court Act where the applicant sought an order under § 38(4) VwGG compelling the lower administrative court to decide its appeal against a decision by the president of a regional Chamber of Commerce; the applicant prevailed on costs but the substantive urgency request became unnecessary because the lower court rendered a decision on the underlying appeal before this court ruled. The legal basis for the termination was the application of § 38(4) VwGG in conjunction with § 33(1) VwGG, which requires declaring such applications moot when the lower court fulfills its decision duty, while the cost allocation and the rejection of separate reimbursement for postal expenses were grounded in §§ 47 ff. and § 56(1) VwGG read with the VwGH Expense Reimbursement Ordinance 2014.
