Procedural extinction of a deadline-setting application under § 38 Abs. 4 VwGG and cost reimbursement under the VwGH Expense Reimbursement Ordinance 2014
Legislator-Zusammenfassung
KI-generiertThe Administrative Court (VwGH) ordered the dismissal of the proceedings and awarded the applicant EUR 793.20 in costs, effectively concluding the case without a substantive review on the merits. The dispute arose from a decision by the Federal Finance Court, which had been served to the VwGH following a timely application for a deadline extension by the applicant. The court ruled that because the underlying administrative decision had been communicated prior to the VwGH proceedings, the deadline-setting application was to be discontinued pursuant to § 38 Abs. 4 VwGG. The cost award was based on §§ 47 ff, specifically § 56 Abs. 1 second sentence VwGG in conjunction with the VwGH Expense Reimbursement Ordinance 2014.
