The Administrative Court of Vienna (VwGH) ordered the discontinuation of the proceedings and dismissed the applicant's claim for compensation of costs, thereby leaving the lower administrative court's judgment of April 11, 2018, in force. The dispute concerned a motion for a deadline request filed by the party subject to litigation, which had been pending before the administrative court in proceedings where that party was explicitly granted party status. The court held that because the statutory deadline to file an appeal to the VwGH had expired, the motion for a deadline request had to be discontinued pursuant to § 38(4) of the Administrative Court Act (VwGG), as the VwGH lacks jurisdiction to review the underlying decision after the deadline. The claim for compensation of legal costs was rejected on the ground that cost reimbursement is not available when the entity liable to pay the costs is identical to the entity to whom compensation would be granted, a doctrine based on the identity of the legal person in this procedural context.

VwGH 19.12.2016, Fr 2016/09/0008).
