Legislator-Zusammenfassung

KI-generiert

The Vienna Administrative Court declared the applicant's request for a deadline setting as moot and dismissed the application for cost reimbursement. The case involved a procedural motion filed on February 12, 2018, which the applicant voluntarily withdrew on February 20, 2018. Relying on the administrative court procedure rules, the court held that pursuant to § 38(4) in conjunction with § 33(1) of the Administrative Court Act (VwGG), the withdrawal rendered the subject matter moot, necessitating the declaration of the request as futile and the termination of the proceedings; the court further applied § 51 VwGG mutatis mutandis to deny the claim for cost reimbursement.
