Mootness of social medical examination summons due to applicant's voluntary compliance with medical inspection
Legislator-Zusammenfassung
KI-generiertThe Administrative Court (VwGH) declared the appeal moot and discontinued the proceedings without awarding litigation costs, resulting in no substantive ruling on the merits of the complaint. The dispute concerned a challenge to a summons issued under the Social Medical Act (SMG) ordering the appellant to appear for a medical examination at a specified date. The court determined that the administrative act was effectively nullified because the appellant had already complied with the summons and undergone the required medical examination, meaning the threatened coercive measure could no longer be applied. Relying on the doctrine of subsequent material mootness (materielle Klaglosstellung), the court applied § 33 Abs. 1 VwGG by analogy to declare the case moot and discontinued the proceedings pursuant to § 58 Abs. 2 VwGH, finding that a decision on costs would constitute a disproportionate burden.
Legislator-Regeste
KI-generiert§ 33 Abs. 1 VwGG; § 58 Abs. 2 VwGG: A complaint is declared moot and proceedings terminated if the underlying matter is resolved by the party's conduct prior to the complaint's filing, and no cost compensation is awarded if the proceedings would cause disproportionate effort.

Volltext
