Legislator-Zusammenfassung

The Administrative Court denied the application for suspensive effect, ruling that the challenged initial administrative decision did not alter the applicant's legal position and thus was not subject to enforcement under § 30 para. 2 VwGG. The dispute concerned a preliminary objection to an immigration administrative act, where the court determined that the immediate consequences of the decision were non-justiciable for interim relief purposes. The decisive legal basis was the scope of § 30 para. 2 VwGG, which limits suspensive effect to enforcement scenarios, noting that private interests are protected later in specific removal proceedings under § 66 FPG and via claims of threat to life under §§ 50–51 FPG.
