Failure to submit valid signed complaint copy renders administrative court proceedings inadmissible under VwGG
Legislator-Zusammenfassung
KI-generiertThe Administrative Court dismissed the complaint as inadmissible, effectively denying the petitioner relief and leaving the challenged administrative act in force. The dispute concerned a procedural challenge to an administrative decision, where the petitioner filed a complaint on February 25, 1991, but failed to provide a complete set of copies required by law. Although the court ordered the petitioner to supply an additional copy for the Minister of Finance, the subsequent submission included a photocopy of the complaint lacking the attorney's signature. Under the decisive legal provisions of § 24 Abs 1 and § 29 VwGG, the court applied its established doctrine that a valid "copy" must include a signature, even in photocopied form; because the unsigned photocopy did not meet this requirement, the court ruled under § 34 Abs 2 and § 33 Abs 1 VwGG that the petitioner had not properly cured the defect, resulting in the termination of the proceedings.
