The Constitutional Court dismissed the applicant's motion for legal aid to file a complaint against a decision of the Federal Administrative Court. The applicant, a married individual earning a net monthly income of €2,434.45, sought assistance to challenge the administrative ruling, but the Court found that her financial condition did not meet the statutory threshold for aid. Despite having debts, the applicant’s reported assets and income were deemed sufficient to cover the costs of legal representation and the filing fee without compromising necessary subsistence. Relying on §63(1) of the Civil Procedure Code in conjunction with §35(1) of the Constitutional Court Act, which require that a party be unable to bear the costs of litigation without impairing necessary livelihood, the Court determined that the prerequisites for granting legal aid were not met, thereby leaving the Federal Administrative Court’s May 26, 2017, decision in force as the applicant is unable to pursue the constitutional appeal.
